I can continue to study this issue using data on the composition of staff from different sectors. Assuming that men and women have the same probability of being subject to compulsory arbitration within the same sector, I can estimate the proportion of men and women subject to binding arbitration agreements based on gender breakdowns of employment by sector from Bureau of Labor Statistics data for 2016. With this approach, I estimate that 57.6 per cent of female employees are subject to compulsory arbitration, slightly higher than the rate of the total population (56.2 per cent), and 53.5 per cent of men are subject to compulsory arbitration.13 In addition, approximately 29.3 million women and 30.8 million male workers are subject to compulsory arbitration. .
